Above The Law Essay The flashing lights of the police cars are blinding to you in your inebriated state. Through your drunken haze, the events leading up to now start to unfold. You were pulling ninety miles an hour in your SUV, when you collided with the bus full of blind orphans. The resulting crash sent the bus careening off the overpass, and onto a passing group of nuns and the governor, killing all of them instantly. The total body count is so far unknown. If you were an average person, you could expect the electric chair without question. Of course, youre far from average. Youre a former Olympic champion who stars in the number one rated show in America, and whose movie has won multiple Academy Awards. You are in fact, a celebrity. Youll be free before you have time to get comfortable in a holding cell. You wont even have to serve any real prison time. At most, youll probably have to serve a few hours of community service. Although this moment seems preposterous, as well as obviously impossible, it essentially occurs all the time to a lesser degree. Athletes and other celebrities are almost always assured that they will usually get a slight fine or a few hours of community service at the most, and still get to wear any time served as a badge of honor. Because of their immense wealth, and more importantly, their huge public standing, they tend to receive an unfair advantage in the courts, while someone who performs the same act is prosecuted to the fullest extent of the law. Because most celebrities possess exorbitant amounts of cash, they can purchase the best legal staff that money can buy. By purchasing legendary attorneys, they can come up with excellent testimony on their behalf, essentially allowing them to beat the system regardless of their crime. As has proven in past cases, these attorneys can pretty much beat any charge leveled against their client. An average person would regrettably have to either settle with a public defender, or a cheaper attorney, neither of which can give an edge for the defendant. A key example of this was when former heavyweight boxer Riddock Bowe kidnapped his wife and children a few years ago. All the evidence was there to convict him and put him away for a long time, but because he had Johnnie Cochran as an attorney, it was argued that he was punch drunk, thereby giving him probation. The limited capacities excuse is a clear argument for celebrities, along with the stupidity excuse, as was shown in the Pedro Guerrero case last year. Daryl Strawberry, Robert Downey, and Kelsey Grammer have all consistently beaten multiple drug, alcohol, and probation violations without any stiff penalties. All are still gainfully employed, and are still granted the right to work at their jobs while serving time. Of course, they almost always break the rules of their release within hours, but its okay since theyre famous. When you are famous, no matter what you do, it is okay as long as you remain famous. This is a perfect sign of a disjointed culture in which role models are allowed to continue their lives with no retribution, while a common man would be blacklisted from any employment after release. It should be made to be that the special treatment is gone, making those with true problems have to be confined until it can proven that whatever problem they have is gone. No one has a job that important that they cant be replaced, and this includes the famous. In a day and age in which those who are famous are for all extensive purposes above the law, it makes one wonder when society will say enough. As is the current trend, although most celebrities get off, one will essentially be justly prosecuted. The scales should be balanced out again by removing any potential legal loopholes as a start. Justice should truly be blind, not dumb or easily swayed. Located on the Potomac River in Washington, D.C. it contains many hotel rooms and offices. What happened in the complex on June 17, 1972 early in the morning became a very historical event for our nation that no one will ever forget. The "Watergate Scandal" and constitutional crisis that began on June 17, 1972 with the arrest of five burglars who broke into the Democratic National Committee (DMC) headquarters at the Watergate office building in Washington D.C. It ended with the registration of President Richard M. Nixon on August 9, 1974. (Watergate) At approximately 2:30 in the morning of June 17, 1972 five men were arrested at the Watergate Complex. The police seized a walkie talkie, 40 rolls of unexposed film, two 35 millimeter cameras, lock picks, pensized teargas guns, and bugging devices. (Gold, 75) These five men and two co-plotters were indicated in September 1972 on charges of burglary, conspiracy and wire tapping. Four months later they were convicted and sentenced to prison terms by District Court Judge John J. Sercia was convinced that relevant details had not been unveiled during the trial and offered leniency in exchanged for further information. As it became increasingly evident that the Watergate burglars were tied closely to the Central Intelligence Agency and the Committee to re-elect the president. (Watergate) Four of these men, that were arrested on the morning of June 17, 1972, came from Miami, Florida. They were Bernard L. Barker, Frank A. Sturgis, Virgillio R. Gonzalez, and Eugenio R. Martinez. The other man was from Rockville, Maryland named James W. McCord, Jr. The two co-plotters were G. Gordon Liddy and E. Howard Hunt. (Watergate) The senate established and investigative committee headed by Senate Sam Ervin, Jr., to look into the growing scandal. As they were investigating, they related that the famous break-in was far more involved than what everyone had expected. (Watergate) The White Houses involvement of that morning first became evident when James McCord wrote a letter to Judge Sirca. In this letter McCord explained that he wanted to disclose the details of Watergate. He made it apparent that he would not speak to a Justice department official of an FBI agent. Although his letter did unveil details, it made server chargers. McCord justified that "Political pressure" (Westerfled 36) had generated many defendants to plead guilty and remain silent. He also claimed that there had been whiteness at the trail who had committed perjury in order to protect the people who headed the brake-in. McCord declared that he, his family, and his friend may be in danger if he spoke out. (Westerfled 36-37) The Senate Watergate Committee saw their chance to unravel the mystery of this scandal. The offered James McCord a chance to speak publicly. In his first meeting with representatives of this committee he named two more people that he claimed were involved in the burglary and cover-up. Theses two men were John Dean and Jeb Margruder. Margruder was the second-in-charge of the CRP and Dean was a White House aid. After hearing these substantial accusations the Senate Watergate Committee promptly subpoenaed John Dean and Jeb Margruder. (Westerfled 37-38). After the next session with James McCord he took the whiteness stand and explained how Liddy had promised him an executive pardon if he would plead guilty. This began to question the a White House involvement since only the president could present such a pardon. (Westerfled, 40) Jeb Margruder was the next witness to testify. He admitted his own perjury to the Grand Jury and verified what McCord had said. While on the stand he also revealed another name to add to the list of those involved, John Mitchell. (Gold, 246-247) The next witness scheduled to appear was John Dean. In Dean's testimony he exposed that the Watergate burglary had been only a part of a greater abuse of power. He said that for four years the White House had used the powers of the presidency to attack political enemies. They spied on and harassed anyone who did not agree with Nixon's policies. If a reporter wrote stories criticizing the White House they would be singled out for tax investigations. The White House also kept an "Enemies List" (Westerfled 43) of people that the presidents men wanted revenge on. After being fired, dean kept official documents that supported his statements. Luego considerara los valores de Kudler Fine Foods como empresa y se comparara con los mismos, explicando como los aspectos de su perfil etico afectarian su desempeno, en caso de ser gerente en dicha organizacion. La etica es un conjunto reglas o principios que guian la buena conducta (N.D.). De acuerdo a la profesion las personas deben aprender como realmente debe ser su conducta en su area de trabajo. El avaluo Ethics Awareness Inventory es una prueba para orientar a las personas que lo toman, sobre su filosofia etica; analizandolas en varias categorias como: caracter, equidad y resultados. Al realizar el avaluo la estudiante no se sintio comoda; no fue de su agrado tener que seleccionar, en muchas de las aseveraciones, las dos opciones requeridas (menos o mas) de cada una; entiende que la etica se compone de una integracion de todos los criterios y considera que se puede tener un balance y no estar exactamente alineado con un area especifica. Por esa razon realizo el assesment en dos ocasiones con el interes de conocer que resultados se acercarian mas a la realidad; tomando en cuenta que el avaluo  ¦es una descripcion general y puede que no se ajuste exactamente a ti (University of Phoenix, 2006). En la primera ejecucion de la prueba, la estudiante obtuvo una puntuacion que la describio con un perfil mas alineado con los resultados. Se explica que desde esa perspectiva, la persona se basa en los consecuencias de sus actos y en promover lo mejor para la mayoria. Al realizar la prueba, nuevamente, obtuvo un perfil etico mas alineado con su caracter y menos con equidad. Este perfil la describe como una persona que le da mas importancia a su caracter, considerando la integridad y rectitud muy importantes; incluye cualidades como honestidad y sabiduria (University of Phoenix, 2006). Luego de haber analizado ambos resultados, la estudiante entiende que en su trabajo presenta un balance de los dos. Es muy recta en su area de trabajo y le gusta ir a la par con las reglas establecidas y la etica, a la vez que puede presentar flexibilidad al tratarse del bien comun. Al analizar la organizacion Kudler Fine Foods, la estudiante puede apreciar que Kathy, la presidenta, contribuye al bien comun cuando dona sus alimentos menos frescos a personas que lo necesitan ( Apollo Group, Inc., 2003). Tambien podemos apreciar sus valores considerando su honestidad, al reconocer que el salario de sus empleados no es el mejor y los recompensa con comida. Kathy muestra su integridad y rectitud al estar presente en cada una de sus tiendas la mayoria del tiempo y su sabiduria al estar al dia con lo que esta vigente en el mercado y nuevas estrategias.( Apollo Group, Inc., 2003). De la estudiante ser la gerente en kudler Fine Foods, su valor de rectitud podria ayudar la organizacion en mantener sus valores y promover la honestidad entre los empleados La gente puede ser termometros o termostatos. Van a reflejar el clima alrededor de ellos, o lo estableceran. Los lideres desarrollan valores y principios para aplicarlos a su vida y trazan el camino para otros (Elmore, 2008, pag.13). La inclinacion de la estudiante de lo que se debe ser y su integridad ante todo, mejoraria la situacion en el area de Recursos Humanos y las tareas que realiza Kathy serian distribuidas a las personas que se supone que las realicen; el enfoque en resultados de la misma manera seria efectivo pues de acuerdo a como los empleados realicen las funciones les continuaria dando confianza y valor por su trabajo realizado Estar facultado significa que uno tiene libertad para actuar; tambien significa que uno es responsable por los resultados(Blanchard, Carlos Randolph, 2005). La inteligencia ayudaria a concienzar sobre la necesidad de delegar en las demas personas como estrategia para poder crecer y expandirse como negocio, abriendo nuevas tiendas en diferentes lugares estrategicos. La estudiante, luego de analizar la filosofia etica que mejor la describe en su desempeno en el area de trabajo y como la aplicaria a la organizacion Kudler Fine Foods, entiende que algunas de las caracteristicas no ayudarian en su funcion como gerente. Pudo aprender que no solo puede enfocarse en como todo debe funcionar de acuerdo a su vision de valores, pues no todas las personas se rigen por los mismos valores; entiende que el caracter de un lider puede llevar una organizacion al exito o a la derrotaThe iceberg represents your leadership. Entiende que es necesario considerar diferentes estrategias que permita que la organizacion realice sus metas; comprendio tambien la importancia del caracter al hablar sobre etica y como esta cualidad ayuda a fomentar ese tipo de comportamiento pues un lider no construye su caracter sin cruzar el puente de la disciplina. La disciplina personal es como un puente que cruza desde donde estas hacia lo que quisieras ser. Te lleva a donde quieres estar(Elmore, 2008). Un buen lider debe actuar con disciplina y demostrar su caracter para influenciar a sus empleados a ser eficientes en su trabajo y lograr asi el comportamiento etico y el exito de la organizac ion la influencia es la esencia del liderazgo, y los lideres poderosos pueden tener un impacto substancial en las vidas de sus seguidores y el destino de una organizacion( Yukl, 2006).
